日本国での永住許可の在留資格を取得すると永住者本人の在留期間は無期限（永住者の配偶者などは５年・３年・１年・６月のいずれかで在留更新許可申請が必要）となり永住者本人や永住者の配偶者なども資格外活動許可を受けずに就労も自由にできるようになる大きなメリットがあります。
日本国への外国人の永住許可申請は、原則引き続き１０年以上の日本国での居住が必要です。（留学の在留資格がある場合には１０年の期間に留学年数以外に就労または身分の在留資格で引き続き５年以上必要）
しかし、永住許可の特例期間（以下のから）により１０年未満でも申請できますのでご注意ください。なお、出入国管理法等法令は難解ですので、法務省出分かりやすく庁から公表されている永住許可に関するガイドラインをわかりやすくコンパクトに以下①から⑧にまとめましたのでご確認ください。また、永住許可に関するガイドラインにない事務取扱も記載し、以下1⃣から8⃣の順番に変えました。
太字の1⃣から3⃣は件数が多くレギュラーです。
1⃣日本人・永住者の配偶者
〇婚姻後実体を伴う婚姻生活を３年以上経過し、かつ、１年以上継
続して日本国に居住。
2⃣日本人・永住者の実子
〇引き続き１年以上継続して日本国に居住。
3⃣定住者
〇引き続き５年以上継続して日本国に居住。
なお、他の就労系・身分系の在留資格と合算可能。
4⃣高度専門職など高度人材外国人
➀高度専門職で永住許可申請日から３年前の時点を基準として高
度人材制度ポイントが７０点以上で引き続き３年以上継続して日本
国に居住。
または、高度専門職以外の在留資格でも高度人材制度ポイントが
７０点以上を保有して引き続き３年以上継続して日本国に居住。
➁永住許可申請日から１年前の時点を基準として高度人材制度ポ
イントが８０点以上で引き続き１年以上継続して日本国に居住。
または、高度専門職以外の在留資格でも高度人材制度ポイントが
８０点以上を保有して引く続き１年以上継続して日本国に居住。
5⃣特別高度人材（特別高度人材の基準を定める省令の基準に該当する外国人）などの外国人
〇引き続き１年以上継続して日本国に居住。
または、特別高度人材以外の在留資格でも永住許可申請日から１
年前の時点を基準として特別高度人材省令に規定する基準に該当す
ることが認められ引き続き１年以上継続して日本国に居住。
6⃣難民認定者など
〇難民認定など以後に引き続き５年以上継続して日本国に居住。
7⃣日本国への貢献認定者（外交、社会、経済、文化等の分野）
〇引き続き５年以上継続して日本国に居住。
なお、貢献が認定される前からの期間を含む。
8⃣日本国への特別貢献認定者
（例：地域再生法に基づく地域再生計画地域内の病院で医師としての医療活動が特別貢献として認められた者）
〇引き続き３年以上継続して日本国に居住。
なお、特別貢献が認定される前からの期間を含む。
Obtaining permanent residence status in Japan allows the permanent resident to stay indefinitely (spouses of permanent residents are required to apply for a 5-year, 3-year, 1-year, or 6-month renewal of their residence status), and this has the great benefit of allowing both the permanent resident and their spouse to work freely without obtaining permission to engage in activities other than those permitted under the status of residence …
In order for a foreigner to apply for permanent residence in Japan, he/she must have continuously resided in Japan for 10 years or more. (If you have a student visa, you must have worked or held a status of residence for at least 5 years in addition to the years of study during the 10-year period.)
However, please note that you can apply for permanent residence even if you have been in Japan for less than 10 years due to the special period for permanent residence (see below). Since the Immigration Control Act and other laws are difficult to understand, we have summarized the guidelines on permanent residence published by the Ministry of Justice in an easy-to-understand and compact format below, from ① to ⑧, for confirmation of possibility of changing your status of residence. We have also included administrative procedures that are not included in the guidelines on permanent residence and have changed the order from 1⃣ to 8⃣ below.
The bolded numbers 1⃣ to 3⃣ are the most common and are regular.
1⃣ Spouse of a Japanese national or permanent resident
〇 Having been in a substantial married life for at least 3 years after marriage and having continuously resided in Japan for at least 1 year.
2⃣ Child of a Japanese national or permanent resident
〇 Having continuously resided in Japan for at least 1 year.
3⃣ Long-term resident
〇 Having continuously resided in Japan for at least 5 years.
In addition, this can be combined with other employment-based or status-based residence statuses.
4⃣Highly skilled foreign nationals, such as highly skilled professionals
➀Highly skilled professionals who have a total of 70 or more points under the Highly skilled Professional Point System based on the date three years prior to the date of application for permanent residence permission and have continuously resided in Japan for more than three years.
Or those with a residence status other than highly skilled professionals who have a total of 70 or more points under the Highly skilled Professional Point System based on the date three years prior to the date of application for permanent residence permission and have continuously resided in Japan for more than three years.
➁Highly skilled foreign nationals who have a total of 80 or more points under the Highly skilled Professional Point System based on the date one year prior to the date of application for permanent residence permission and have continuously resided in Japan for more than one year.
Or those with a residence status other than highly skilled professionals who have a total of 80 or more points under the Highly skilled Professional Point System based on the date one year prior to the date of application for permanent residence permission and have continuously resided in Japan for more than one year.
5⃣Foreign nationals, such as special highly skilled professionals (foreign nationals who meet the criteria of the Ministerial Ordinance that stipulates the criteria for special highly skilled professionals)
〇Continuously resided in Japan for more than one year.
Or, if the person has a status of residence other than that of a special highly skilled foreign professional, they have been recognized as meeting the criteria set forth in the Special Highly Skilled Foreign Professionals Ordinance based on the date of application for permanent residence permission one year prior and have been residing in Japan for more than one year.
6⃣Persons recognized as refugees, etc.
〇Residing in Japan for more than five years after being recognized as a refugee, etc.
7⃣Persons recognized as contributors to Japan (diplomacy, society, economy, culture, etc.)
〇Residing in Japan for more than five years.
Note that this includes the period before their contributions were recognized.
8⃣Persons recognized as special contributors to Japan
(Example: A person whose medical activities as a doctor at a hospital in a regional revitalization plan area based on the Regional Revitalization Act have been recognized as a special contribution)
〇Residing in Japan for more than three years.
Note that this includes the period before their special contributions were recognized.
