特定行政書士の職務権限拡大へ-令和8年(2025年)1月1日から-Expansion of the authority of Specified Administrative Procedures Legal Specialists – from January 1, 2025 –


 改正行政書士法(行政書士法の一部を改正する法律)が令和7年(2025年)6月6日に参議院で全会一致で可決され令和8年1月1日から施行されます。重要な改正点は行政書士の使命・職務責任の明確化、非行政書士行為の罰則強化、行政書士試験の一部改正とともに特定行政書士の職務権限拡大であります。
 改正前は、特定行政書士による行政庁に対する行政不服審査申立てが「行政書士が作成した官公署に提出する書類に係る許認可等」に限られていましたので、本人(法人・個人)による許認可申請などを含めて行政書士以外が関与した事案を取り扱えませんでした。通常、行政書士が代理人として許認可申請した場合に不許可となることが少ないので、特定行政書士の登場の機会は限られていました。
 改正後は、特定行政書士による行政庁に対する行政不服審査申立てが「行政書士が作成することができる官公署に提出する書類に係る許認可等」に拡大しましたので、本人(法人・個人)による許認可申請などを含めて行政書士以外が関与した事案を取り扱えるようになります。実際、行政手続きに不慣れな本人(法人・個人)による許認可申請などで不許可となる事案が非常に多いので、特定行政書士による行政救済が大幅に拡大します。
 行政書士が取り扱える許認可申請は1,000以上あります。これらの本人(法人・個人)による許認可申請などへの不許可に対して特定行政書士が行政不服審査ができるようになります。
 
 具体的な事例ですと、例えば不動産会社でしたら宅建業免許自体だけでなく宅地分譲開発などに伴う各種法令上の許認可申請に対する行政庁の不許可や保留についての行政不服申立について、改正前の行政書士法であれば、行政書士が関与しない不動産会社申請が非常に多いため特定行政書士が代理人として委任を受けて行政不服審査法による簡易迅速な手続きによる行政庁に対する再調査や審査請求などの行政不服申立てが事実上出来ませんでした。そして、このため不動産会社は、許認可申請に対する行政庁の不許可や保留について行政庁に対して多額の裁判費用と長期間の時間をかけて裁判を起こす選択肢しかありませんでした。仮に裁判を起こしても行政庁を相手に勝訴する確率は非常に低いので、不動産会社の多くは不動産事業の継続を断念するしか道はありませんでした。
 なお、不動産会社申請で不許可や保留になるケースの多くは申請手続書類不備などのミスが原因であり、一方、行政庁側も補正を要求せず事務的に不許可や保留にしている件数も非常に多いと言われています。

 しかし、令和8年1月1日から施行される改正行政書士法により、不動産会社からの委任を受けて行政手続きに精通した特定行政書士が不動産会社の代理人として委任を受けて行政不服審査法による簡易迅速な手続きによる行政庁に対する再調査や審査請求などの行政不服申立てが出来るようになりました。
 
 令和7年(2025年)4月1日現在、全国の行政書士は約5万3千名いますが、このうち特定行政書士研修(弁護士・法学者・総務省担当官が講師の研修)を受講し考査(試験)に合格した特定行政書士登録者は約6千名です。私も特定行政書士の1人です。

The revised Act to partially revise the Certified Administrative Procedures Legal Specialist Law was unanimously passed by the House of Councilors on June 6, 2025, and will come into effect on January 1, 2026. Important changes include clarifying the mission and responsibilities of Certified Administrative Procedures Legal Specialists, strengthening penalties for non-Certified Administrative Procedures Legal Specialist acts, and partially amending the Administrative Scrivener Examination, as well as expanding the scope of authority for Specified Administrative Procedures Legal Specialists.

Before the amendment, administrative appeals by Specified Administrative Procedures Legal Specialists to administrative agencies were limited to “licenses and permits related to documents prepared by Certified Administrative Procedures Legal Specialists to be submitted to public offices,” so cases involving people other than Certified Administrative Procedures Legal Specialists, including applications for licenses and permits by the principal (corporation or individual), could not be handled.
Normally, when a Certified Administrative Procedures Legal Specialist applies for a license or permit as an agent, it is rare for the application to be denied, so there were limited opportunities for Specified Administrative Procedures Legal Specialists to appear.

After the amendment, the scope of administrative appeals filed by Specified Administrative Procedures Legal Specialists against administrative agencies has been expanded to include “licenses and permits related to documents submitted to public offices that Certified Administrative Procedures Legal Specialists can prepare,” meaning that they will be able to handle cases involving non-Certified Administrative Procedures Legal Specialists, including applications for licenses and permits made by individuals (corporations and individuals). In fact, there are many cases where applications for licenses and permits made by individuals (corporations and individuals) who are unfamiliar with administrative procedures are denied, so the administrative relief available to Specified Administrative Procedures Legal Specialists will be greatly expanded.

There are more than 1,000 applications for licenses and permits that Certified Administrative Procedures Legal Specialists can handle. Specified Administrative Procedures Legal Specialists will be able to conduct administrative appeals against the denial of applications for licenses and permits made by these individuals (corporations and individuals).

As a specific example, for example, in the case of a real estate company, regarding administrative appeals against the denial or suspension of the administrative agency for various legal permits and licenses related to not only the real estate license itself but also land development and other legal permits and licenses, under the Certified Administrative Procedures Legal Specialist Act before the amendment, there were so many applications from real estate companies that Certified Administrative Procedures Legal Specialists were not involved in, that it was practically impossible to have a designated administrative scrivener delegated as an agent and file an administrative appeal such as a reinvestigation or review request against the administrative agency through the simple and quick procedure under the Administrative Appeal Examination Act.

Therefore, real estate companies had no choice but to sue the administrative agency for the denial or suspension of the license application, which would require a large amount of legal fees and a long time. Even if they did sue, the chances of winning against the administrative agency were very low, so many real estate companies had no choice but to give up on continuing their real estate business.
In addition, many of the cases in which real estate company applications are denied or suspended are due to mistakes such as incomplete application documents, while it is said that there are also a very large number of cases in which the administrative agency does not request corrections and denies or suspends the application in a clerical manner.

However, under the revised Certified Administrative Procedures Legal Specialist Act, which will come into effect on January 1, 2026, a Specified Administrative Procedures Legal Specialist who is familiar with administrative procedures and is delegated by a real estate company can now act as the real estate company’s agent and file administrative appeals, such as reinvestigations and requests for review, with administrative agencies through simplified and speedy procedures under the Administrative Appeal Act.

As of April 1, 2025, there are approximately 53,000 Certified Administrative Procedures Legal Specialists nationwide, of which approximately 6,000 are registered Specified Administrative Procedures Legal Specialists who have passed the Specified Administrative Procedures Legal Specialist training (lecturers include lawyers, legal scholars, and Ministry of Internal Affairs and Communications officials) and examination (examination).
