
「民事関係手続等における情報通信技術等の活用等の推進を図るための関係法律の整備に関する法律(令和5年6月14日法律第53)」により公証人法の一部が改正され来月から公正証書(保証意思宣明公正証書など一部を除く)が、従来の紙製書面による公正証書の交付方法に加えて、電磁的記録媒体(CD-R等)による電子公正証書の交付を受けられるようになり、電子公正証書遺言書を作成できるようになりました。また、公正証書遺言の作成のために遠隔地であったり心身の状況などで公証役場に行くことが困難な人で公証人がWeb方式を必要と認めた場合には、Web方式※のリモートで公証人と証人2人以上と対面して電子公正証書遺言書を作成することもできるようになりました。
※Web方式による電子公正証書遺言書作成の要件
➀遺言者または遺言者の代理人の申し出があること。
②他の関係者の異議がないこと。
➂公証人が相当と認めること
⇒⑴必要性と⑵許容性を総合的に勘案して判断
➃法令上許容されていること。
⑴必要性⇒遺言者が公証役場に赴くことが困難などの場合
1.年齢・心身の状況その他の状況等
2.離島その他の地理的事情による公証役場へのアクセスの困難
3.遺言者が同席困難
4.日程調整の困難
5.感染症予防等による制限
⑵許容性⇒遺言者の本人確認・真意確認・判断能力確認の難易など
1.事後的にトラブルとなる蓋然性の有無・程度
2.遺言書の内容
電子公正証書遺言の作成手順は、タブレット(タッチ入力ディスプレイ登載)とタッチペンにより以下➀から➇のとおりとなります。
➀遺言者の本人確認
②遺言者の意思確認
➂公証人による遺言書読上げと確認
➃公証人による遺言書原本用PDF作成
➄遺言者と証人の電子署名
⑥公証人の電子署名と電子押印(公証人職印のPDF埋込み方式)
➆完成した電子公正証書遺言書の原本PDFを公証役場に登録
➇電子公正証書遺言書の正本と謄本をCD-R等で遺言者に交付
Web方式に必要な機材(遺言者や証人など公証役場以外にいる当事者も準備する必要機材)は以下➀から➂となります。
なお、Microsoft Teams会議を利用して実施されます。

The “Act on the Development of Relevant Laws to Promote the Use of Information and Communications Technology, etc. in Civil Procedures, etc. (Act No. 53 of June 14, 2023)” amended the Notary Public Act, and starting next month, notarized deeds (with the exception of some items such as notarized deeds of guarantee) will be issued electronically on electromagnetic recording media (CD-R, etc.) in addition to the traditional method of issuance of paper documents. This also makes it possible to create electronic notarized wills. Furthermore, for those who are unable to visit a notary public office due to remote location or physical or mental condition, and the notary public deems the online method necessary, it is now possible to create an electronic notarized will remotely via the web, with a notary public and two or more witnesses present in person.
*Requirements for creating an electronic notarized will via the web
1. The testator or their representative must request it.
2. There must be no objections from other parties.
3. The notary public must deem it appropriate.
⇒Judgment is made after comprehensive consideration of (1) necessity and (2) permissibility.
4. It must be legally permitted.
(1) Necessity ⇒ Cases where it is difficult for the testator to attend a notary public office.
1. Age, physical and mental condition, and other circumstances.
2. Difficulty in accessing the notary public office due to remote islands
or other geographical reasons.
3. Difficulty in the testator’s attendance.
4. Difficulty in coordinating a schedule.
5. Restrictions due to infectious disease prevention measures, etc.
⑵ Permissibility ⇒ Difficulty in verifying the testator’s identity, true intentions, and capacity to make decisions.
1. Presence and degree of likelihood of subsequent problems.
2. Contents of the will.
The steps for creating an electronic notarized will are as follows (1) through (5) using a tablet (with a touch input display) and a stylus
: 1. Identification of the testator
2. Confirmation of the testator’s intentions
3. Reading and confirmation of the will by a notary public
4. Creation of a PDF of the original will by a notary public
5. Electronic signatures of the testator and witnesses
6. Electronic signature and electronic seal of the notary public (notary
public’s official seal embedded in the PDF)
7. Registration of the original PDF of the completed electronic
notarized will with the notary public’s office
8. Delivery of the original and certified copies of the electronic
notarized will to the testator on a CD-R or other medium
The equipment required for the online method (equipment that must be prepared by parties outside the notary public’s office, such as the testator and witnesses) is listed below. The online method will be conducted using Microsoft Teams meetings.
1. Computer (smartphones and tablets are not suitable as screen
sharing is not possible)
