法定相続情報証明制度について About the legal inheritance information certification system

　相続の手続きでは、金融機関（預貯金・有価証券の払戻し）・法務局（不動産登記）・税務署（相続税申告）・社会保険事務所（遺族年金請求）などで戸籍謄本などが必要となります。
　具体的には、①被相続人（亡くなられた人）出生から死亡までの全ての戸籍謄本・除籍謄本と住民票除票写し、➁相続人の戸籍謄本と住民票写しが必要となります。そのため戸籍謄本などが束のようになる場合があります。相続手続き関係機関では、原則として戸籍謄本などは原本還付をしてくれますが、原本還付まで日数を要する場合などもあり相続手続きがスムースに進められない事が多いです。
　そこで、平成２９年（２０１７年）５月の法定相続情報証明制度が創設されました。法定相続情報証明制度とは、相続人から「法定相続情報一覧図（被相続人（亡くなられた人）と全ての相続人の関係系図を一覧にした図）」「法定相続情報一覧図の保管及び交付の申出書」とともに、「被相続人と相続人の戸籍謄本など・被相続人の住民票除票写し・相続人の住民票写しなど」を管轄法務局（①被相続人の死亡時本籍地・②被相続人の最後の住所地・③申出人の住所地・④被相続人名義の不動産の所在地のいずれかを選択）に提出して、一覧図の内容が民法に定められた相続関係と合致していることを登記官が確認したうえで、「法定相続情報証明書（提出した一覧図に登記官の認証文を付した写し）」を無料で交付するという制度です。
　なお、同時提出する「法定相続情報一覧図の保管及び交付の申出書」により「法定相続情報証明書」を何通請求しても無料ですので、相続手続きのため多めに請求するのが宜しいです。
　ただし、法定相続情報証明制度は日本国籍を有する人のみが利用できるため、被相続人（亡くなられた人）か相続人のいずれかが外国籍の人や無国籍の人の場合には利用することができません。また、相続関係機関の中には、少数ですが「法定相続情報証明書」を取り扱ってない場合もありますので、ご不明な場合には提出先の機関にお問い合わせください。

　In inheritance procedures, financial institutions (withdrawals of deposits and securities), the Legal Affairs Bureau (real estate registration), the tax office (inheritance tax returns), and the Social Insurance Office (survivor’s pension claims) require certified copies of family registers and other documents.
　Specifically, 1) all certified copies of the family register and removal from the family register and copies of the removal from the resident register of the deceased (the person who has passed away) from birth to death, and 2) certified copies of the family register and copies of the resident register of the heirs are required. As a result, you may end up with a pile of certified copies of family registers and other documents. In principle, institutions involved in inheritance procedures will return the originals of certified copies of family registers and other documents, but there are cases where it takes several days for the originals to be returned, and inheritance procedures often do not proceed smoothly.
　As a result, the Legal Inheritance Information Certification System was established in May 2017. The legal inheritance information certification system is a system in which an heir submits a “legal inheritance information chart (a chart listing the family tree of the decedent (deceased person) and all heirs)” and an “application for storage and issuance of the legal inheritance information chart” along with “certified copies of the decedent’s and heirs’ family registers, copies of the decedent’s removal from the resident register, copies of the heirs’ resident registers, etc.” to the jurisdiction’s Legal Affairs Bureau (choose from one of the following: ① the decedent’s registered domicile at the time of death, ② the decedent’s last address, ③ the applicant’s address, or ④ the location of the real estate in the decedent’s name). The registrar then verifies that the contents of the chart match the inheritance relationships stipulated in the Civil Code, and issues a “legal inheritance information certificate (a copy of the chart submitted with a certified statement by the registrar)” free of charge. Please note that no matter how many “Legal Inheritance Information Certificates” you request, they are free of charge when you submit the “Application for Storage and Issuance of Legal Inheritance Information List” at the same time, so it is a good idea to request more than one for the inheritance procedures.
However, since the legal inheritance information certification system is only available to people with Japanese nationality, it cannot be used if either the deceased or the heir is of foreign nationality or stateless. Also, there are a small number of inheritance-related institutions that do not handle “Legal Inheritance Information Certificates,” so if you are unclear, please contact the institution to which you are submitting the document.
